Representation of the Investor in formal procedures together with collection of administration decisions required by law in investment process

Construction investment involves settling several formal matters and obtaining administrative decisions required by law. Depending on the complexity and size of the investment, the range of necessary formal procedures may vary considerably. In case of any construction project following activities are required:

 

  • Determining land development conditions

Obtaining an extract from the local land development plan, if exist, and in other case obtaining a decision on the conditions of land development.

  • Obtaining the right to perform construction works.

Construction works can be commenced only after the final decision on the building permit or, in some cases specified in the Construction Law, within 30 days of the relevant notification to the architectural and building administration together with no objection by the building authority.

  • Obtaining right to use the object.

Use of a building object is possible after 14 days of the notification of the construction supervisor authority about the completion of the construction together with no objection by the authority or, in the cases specified in the Construction Law, after obtaining the final decision on the use.

 

Depending on the nature of the investment, it may also be necessary to obtain other listed below administrative decisions, among others:

 

  • Decision on environmental conditions

  • Permit for demolition

  • Authorizations of historical conservator

  • Water and legal permits and other decisions required by the Water Law

  • Permit for introduction of substances or energy into the environment

  • Permission to remove trees and bushes

  •  

The omission or incorrect handling of the mentioned above formal procedures may result in serious delays in the investment process or the need for costly changes to the constructed object, so it is important to entrust the professional experienced in both dealing with officials and in the practical application of the law.

The service includes legal analysis of the planned investment resulting in list of the necessary procedures. Applications for administrative decisions will be prepared together with substantive appendices and formal documents. The investor, after giving the appropriate powers of attorney, will be represented in contacts with the authorities, from submission of the application to obtaining a final decision.
